1. Understanding These Terms

Welcome to Sculptaverium. These Terms and Conditions establish the rules governing access to our website, purchases of decorative items, delivery arrangements, cash-on-delivery transactions, cancellations, returns, refunds, and communications with us.

By accessing our website or submitting an order, you acknowledge that your interaction with Sculptaverium is subject to these Terms and Conditions and any applicable Hong Kong legislation.

Our services are intended exclusively for customers ordering decorative items for delivery within Hong Kong. Orders requesting delivery outside Hong Kong are not accepted.

2. Using Our Website

You may browse our website to view decorative items, product descriptions, dimensions, available options, prices, and other information we provide.

You agree not to misuse our website, interfere with its operation, attempt unsolicited access to restricted areas, introduce harmful material, impersonate another individual, submit intentionally inaccurate information, or use the website for unlawful purposes.

Website availability may occasionally be interrupted because of maintenance, system changes, service-provider interruptions, or circumstances outside our reasonable control.

3. Product Information

We aim to present decorative items through useful descriptions, photographs, dimensions, specifications, and other relevant details.

Colors and visual characteristics displayed on a screen can vary according to device settings, lighting, photography, and display configuration. Minor visual differences that naturally arise from materials, finishes, textures, or production characteristics may also occur where applicable.

Customers should read the complete product description before ordering.

Where dimensions or a size guide is provided, customers are encouraged to review that information and consider the intended placement before submitting an order.

4. Availability of Items

Products displayed on our website are subject to availability. An item appearing on the website does not create an unconditional obligation for us to supply it.

If an ordered item becomes unavailable before dispatch, we may contact you using the information supplied with your order and explain the available options.

We may also correct obvious errors relating to product information, availability, descriptions, or pricing when reasonably necessary.

5. Prices and Cash on Delivery

Sculptaverium uses cash on delivery as its exclusive payment method for product orders.

Customers do not pay for their purchases through cards, online banking, digital wallets, or advance transfers when placing an ordinary order through our website. The applicable purchase amount is collected in cash when the order reaches the customer's doorstep.

There is no additional cash-on-delivery charge, shipping fee, or routine handling fee added to an order.

Customers should have the required cash available when delivery takes place.

6. Hong Kong Delivery Area

We deliver exclusively within Hong Kong. A complete and accurate Hong Kong delivery address must be supplied when an order is submitted.

Orders addressed outside Hong Kong will not be accepted for delivery.

Customers are responsible for providing sufficient recipient, address, and contact information. Incorrect or incomplete information may cause delays or prevent delivery.

We may contact a customer when clarification of delivery information is reasonably necessary.

7. Preparing and Delivering Orders

Our standard order preparation period is approximately two business days. This time is used for internal review, order organization, and suitable packaging before the parcel leaves our premises.

After dispatch, delivery generally requires an additional one to two business days within Hong Kong. The overall estimated timeframe is therefore approximately three to four business days.

Business days exclude Saturdays, Sundays, and Hong Kong public holidays.

Delivery periods are estimates. Severe weather, transportation interruptions, access restrictions, public holidays, incorrect delivery information, or circumstances outside our reasonable control may affect arrival times.

All standard deliveries within Hong Kong are free.

8. Canceling an Order

Customers may request cancellation while an order has not been dispatched.

To request cancellation, contact Sculptaverium at artworj@sculptaverium.com as soon as possible and provide sufficient order information.

Once the parcel has been dispatched, the order cannot be canceled. Customers should therefore submit cancellation requests promptly.

The cancellation restriction does not prevent a customer from exercising an applicable return right after delivery where the requirements of our Return and Refund Policy are satisfied.

9. Return Eligibility

An eligible return request must be submitted within 30 calendar days from the date the order was delivered.

Returns are available when an item arrives damaged or defective, or when the customer receives an item different from the one ordered.

Returns are not offered solely because a customer changes their mind, changes their preference, or decides that an accurately supplied item is no longer wanted.

The returned product should remain in its original condition, unused, unworn where applicable, and accompanied by its original packaging and relevant components.

10. Doorstep Return Collection

When a return request satisfies our eligibility requirements, Sculptaverium will arrange collection from the customer's doorstep within Hong Kong.

Our team will coordinate with the customer to establish a suitable collection date and time.

Customers are not charged a return collection fee or restocking fee for an eligible return. The item should be suitably repacked and available at the agreed collection time.

11. Assessment and Replacement

After a returned product reaches us, we require one working day to assess the item and the reported issue.

Where the return meets the applicable requirements, a replacement may be offered if the same item remains available in stock.

Replacement orders follow our ordinary delivery process. This generally means approximately two business days for preparation followed by one to two business days for delivery.

If the same item is unavailable, an eligible refund may be arranged.

12. Refund Arrangements

Since purchases are completed through cash on delivery, eligible refunds are issued through bank transfer.

When a refund is due, we will request the necessary bank information from the customer by email. Customers should provide only information reasonably required to facilitate the transfer and should review communications before sharing banking information.

We initiate an eligible transfer within one working day after receiving the necessary details.

The amount may require approximately eight to ten business days to appear in the customer's account, depending on the processing procedures of the relevant banking institution.

No refund administration or restocking fee is imposed on an eligible return.

13. Personal Information and the PDPO

When customers order, communicate with us, request delivery, or use our return process, Sculptaverium may collect personal information necessary for those activities.

Personal information is handled with reference to the Personal Data (Privacy) Ordinance (Cap. 486) and applicable Data Protection Principles.

Information may include a customer's name, email address, telephone number, delivery address, order records, correspondence, and information required for an eligible bank-transfer refund.

Our Privacy Policy provides further information concerning collection, use, disclosure, retention, access, and correction of personal information.

14. Hong Kong Consumer Legislation

These Terms and Conditions are intended to operate consistently with applicable Hong Kong requirements.

Relevant legislation may include the Sale of Goods Ordinance (Cap. 26), which addresses matters concerning contracts for the sale of goods, and the Trade Descriptions Ordinance (Cap. 362), which contains requirements relevant to trade descriptions and commercial practices.

The Control of Exemption Clauses Ordinance (Cap. 71) and Unconscionable Contracts Ordinance (Cap. 458) may also apply to contractual provisions in relevant circumstances.

Electronic interactions and records may additionally be subject to the Electronic Transactions Ordinance (Cap. 553).

Nothing in these Terms is intended to exclude, limit, or override a statutory consumer right where such exclusion or limitation is not permitted under applicable Hong Kong legislation.

15. Website Materials

Unless otherwise stated, website materials belonging to Sculptaverium, including original written content, graphics, layout elements, product presentation, and other proprietary materials, may not be copied, republished, distributed, commercially exploited, or substantially reproduced without appropriate permission.

Customers may use our website materials for ordinary personal browsing associated with considering or making purchases.

16. Responsible Customer Information

Customers should provide accurate information when placing orders or contacting us.

You should not intentionally provide another person's personal information without an appropriate basis or submit fake order, return, delivery, or refund information.

Where information changes before dispatch, customers should contact us promptly. We will determine whether the requested change can reasonably be accommodated based on the order's current stage.

17. Circumstances Outside Reasonable Control

Certain events may temporarily prevent or delay performance of our obligations. Examples include severe weather, transportation disruption, government restrictions, widespread service interruptions, emergencies, or other circumstances outside reasonable operational control.

Where such circumstances occur, we will seek to manage affected orders reasonably and communicate relevant information when practicable.

18. Relationship Between Our Policies

These Terms should be read together with our Shipping Policy, Return and Refund Policy, and Privacy Policy.

Each policy addresses a particular part of the customer relationship. If a provision must be interpreted alongside applicable legislation, the relevant statutory requirements will prevail where required.

19. Governing Law

These Terms and Conditions and purchases made through Sculptaverium are governed by the applicable laws of Hong Kong.

Any dispute concerning these Terms, an order, delivery, return, or refund will be addressed according to applicable Hong Kong law and the jurisdiction of the relevant Hong Kong courts, subject to any rights or procedures available under applicable legislation.
